Step-by-step — individual flat NOC

  1. Read your allotment / sale deed. Note whether terrace is exclusive, common, or “exclusive use of common area.” That phrase changes everything.
  2. Check society bye-laws. Some ban external fixtures; others allow with committee consent. Maharashtra, Karnataka, Delhi, and Gujarat RWAs often have ad-hoc policies — few had solar clauses before 2020.
  3. Submit a written request to secretary with: proposed kW, panel layout (north/south, setback from tank), vendor name, empanelment proof, and structural certificate from a licensed engineer.
  4. Offer indemnity language — owner (or vendor) bears waterproofing repair cost for penetration zones; society not liable for generation shortfall.
  5. Committee meeting. Present 10 minutes; leave a one-page FAQ. Avoid debating brand wars in the lobby WhatsApp group first.
  6. Written NOC on letterhead — signed president + secretary, society stamp, flat number, plant kW, validity date. Scan for DISCOM and pmsuryaghar.gov.in upload if required.
  7. Only then sign vendor contract and apply for DISCOM feasibility — installing before NOC risks removal and subsidy loss.

Step-by-step — RWA / AGM resolution (common-area plant)

  1. Form a small owner sub-committee (3–5 flats) to compare quotes — not one vendor’s friend on the MC.
  2. Feasibility memo: shadow-free kW cap, common load profile (lifts, pumps, lighting), CFA at ₹18k/kW GHS rate vs individual paths.
  3. Circulate agenda 14–21 days before AGM as bye-laws require; attach vendor comparison and draft resolution text.
  4. AGM resolution items typically include: appoint vendor, approve roof use, authorize office-bearers to sign DISCOM / portal forms, and approve savings credit method (per flat fixed ₹, per sq ft, or against maintenance).
  5. Post-AGM: registered minutes, bank resolution if CFA account needed, single point contact for DISCOM.

Many DISCOMs (including several in Maharashtra, Karnataka, Telangana, and NCR) ask for society NOC upload during net-meter application or commissioning inspection. PM Surya Ghar may reject CFA if roof-rights documents do not match the applicant name. Sequence matters: NOC → feasibility → install → inspection → CFA DBT, not the reverse.

Can the managing committee legally block solar entirely?

Depends on bye-laws, ownership rights, and state housing rules. Some top-floor owners with exclusive terrace rights have challenged blanket bans — but litigation is slow and expensive. Negotiation with structural proof is usually faster. This is not legal advice; consult local counsel if blocked unfairly.

Does NOC mean the society owns my panels?

Not unless the resolution says so. Standard individual NOC grants permission to install on common roof area allocated to your flat — ownership stays with you. Read the NOC text before signing.

Is a WhatsApp “ok” from the secretary enough?

Treat informal chat as progress, not proof. DISCOM and subsidy audits want signed letterhead NOC or registered AGM minutes. Follow up in writing.
